System/Services Valuation

Assignments have included liquidation and "fair market" valuation of computer systems, software and related equipment for matters dealing with business dissolutions, insurance, bankruptcies and allegations of arson. He has prepared written opinions and given depositions and courtroom/arbitration testimony. Examples include:

• Testified in AAA arbitration regarding services fees comparing fess attributable to development to fees attributable to implementation services.
• Testified in AAA arbitration regarding software cost. Issue was value of non-functioning modules of a municipal software package.
• Prepared report on value of computer store inventory after a fire (settled prior to testimony).
• Prepared report on system and network valuation, used to resolve a dispute pursuant to the breakup of a professional services firm.

Criminal

Assisted with pre-trial discovery for defense as an expert consultant in an alleged bank fraud. The issues related to computer security and unauthorized electronic funds transfer. [Note: Business Automation does not accept assignments relating to allegations of pornography or child abuse.]

Regulatory, Procurement and Tax

Consulting and testifying expert engagements in several matters involving governmental regulation and allegedly flawed commercial and governmental procurement of computer equipment and other regulatory and tax issues. These plaintiff and defense matters have involved such subject areas as:

• Testified at state government hearing regarding protest of a governmental procurement.
• Prepared report regarding rescision of a computer contract signed under suspicious circumstances.
• Prepared report in an immigration matter relating to a computer professional's immigration status.
• Prepared report in a tax matter relating to portion of computer system investment attributable to taxable versus non-taxable items.

Brooks Hilliard's efforts have included the production of opinion letters and affidavits, assistance with settlement negotiations, deposition testimony and public testimony at a regulatory agency hearing.
